USAGE & LICENSING INFORMATION

This Usage & Licensing Information explains general principles governing creative work produced or distributed by VIRGINIASWHITE Studio.

Client Work

Rights to final client deliverables depend on the applicable service, product, proposal, agreement, statement of work, and license.

Payment for a service does not necessarily transfer every intellectual-property right associated with the project.

Final Deliverables

When ownership of specified final deliverables is expressly transferred, that transfer applies only to the final deliverables identified in the governing agreement and after applicable payment requirements have been satisfied.

Working Files

Unless expressly transferred in writing, VIRGINIASWHITE Studio retains rights in applicable:

  • Concepts

  • Drafts

  • Unused concepts

  • Unused designs

  • Source files

  • Working files

  • Preliminary materials

  • Processes

  • Methods

  • Templates

  • Tools

  • Internal production materials

Third-Party Materials

Projects may contain third-party materials such as:

  • Fonts

  • Stock photography

  • Stock video

  • Music

  • Software

  • Templates

  • Plugins

  • Illustrations

  • Other licensed assets

Third-party materials remain subject to their applicable licenses.

VIRGINIASWHITE Studio cannot transfer ownership rights it does not own.

Digital Products and Membership Resources

Studio templates, guides, workbooks, educational materials, downloads, and membership resources remain VIRGINIASWHITE Studio intellectual property unless expressly stated otherwise.

Access generally provides a license to use the material within the applicable permitted scope rather than transferring ownership.

Client-Provided Materials

Clients retain their applicable rights in materials they provide to VIRGINIASWHITE Studio.

Clients grant VIRGINIASWHITE Studio the permission reasonably necessary to use those materials to perform the agreed services.

Clients are responsible for ensuring they have appropriate rights to provide and authorize use of those materials.

Portfolio Rights

Subject to applicable confidentiality obligations and project-specific agreements, VIRGINIASWHITE Studio may reserve or request rights to display eligible completed public-facing work in its:

  • Portfolio

  • Website

  • Social media

  • Case studies

  • Presentations

  • Awards submissions

  • Promotional materials

Unauthorized Use

Use beyond the rights granted under an applicable agreement, product license, or written permission is not authorized.
